GROUNDWATER –

Notice is hereby given that W.J. Jacobs Water, LLC c/o Colby J. Byrd, 8th Floor, Two Leadership Square, 211 N. Robinson, Oklahoma City, OK 73120, under the authority given in Oklahoma State Law, Title 82 §1020.7, has filed an application with the Oklahoma Water Resources Board, pursuant to Board rules, to amend groundwater permit #1984-647 by deleting two (2) wells located as follows: one (1) well in the SW NW NE of Section 1 and one (1) well in the SE SW NE of Section 2; both in TIS, R4EIM, Johnston County.

Then adding two (2) wells located as follows: one (1) well in the SW SW SW of Section 1 and one (1) well

in NW NE NE of Section 2; both in TI S, R4EIM, Johnston County. This will bring the total number of wells for this permit to two (2). The land dedicated to the permit is 1,540 acres with a total of 308 acre-feet of groundwater per calendar year for the purpose of municipal use, also by removing the industrial use and adding agriculture use to the permit. All other aspects of the permit remain the same, viewable at oklahoma.gov/owrb. Wells and dedicated lands are located over the Arbuckle-Simpson major groundwater basin, which falls within the statutory definition of a “sensitive sole source groundwater basin” under 82 O.S. § 1020.9A. Board rules require the well be located a distance of at least 1,320 feet from existing wells or

proposed well locations on lands of another unless a well location exception is granted. Board rules also require the well be located a distance of at least 1,320 feet from a spring or stream segment as more specifically defined under OAC 785:30-3-6(c)( 1), unless a well location exception is granted. The Board has

completed a hydrologic study for this groundwater basin and has established a maximum annual yield, with the equal proportionate share allocated as two-tenths (0.2) acre-foot per acre of dedicated land to be used for permitted groundwater. Use of groundwater is governed by Sections 1020.1 and following of Title 82 of the

Oklahoma Statutes and rules of the Board, Oklahoma Administrative Code, Title 785, Chapters 4 and 30

Protests to the application must be in writing and received by the Board at the address listed below and by the applicant at the address listed above no later than January 19, 2026, and contain the following: (1) name, address, and telephone number of the interested person; (2) the particular application number to which the protest relates; (3) specific information to show how approval of the application proposed may directly and adversely affect legally protected interests of the person filing the protest; and (4) a statement of the relief sought by the interested person. A person who sends a letter containing only a general objection or comment will not be deemed to be a party, but the letter will be made part of the permanent record. 

A HEARING ON THIS APPLICATION HAS BEEN SCHEDULED. A hearing will be held on March 18,

2025 at 9:30am, in the 2nd floor Boardroom at Oklahoma Water Resources Board Headquarters, 3800 N. Classen Blvd., Oklahoma City, Oklahoma 73118. Applicant(s) shall appear then and there and prove why

the application should be approved. Protesting parties or their representatives must appear at the hearing and present the protest in order that it may be considered.
