Under and by virtue of Section 26, Article X of the Oklahoma Constitution and Title 70, Article XV, Oklahoma Statutes 2021, and other laws supplementary and amendatory thereto and a Resolution of the Board of Education of Independent School District Number 35 of Johnston County, Oklahoma, adopted on the 16th day of September, 2025, an election is hereby called to be held in said School District on the 18th day of November, 2025, for the purpose of submitting to the registered qualified electors thereof the following proposition:

“Shall Independent School District Number 35 of Johnston County, Oklahoma, incur an indebtedness by issuing its bonds in the sum of Eight Hundred Thousand Dollars ($800,000)  to provide funds for the purpose of constructing, equipping, repairing and remodeling school buildings, acquiring school furniture, fixtures and equipment and acquiring and improving school sites and levy and collect an annual tax, in addition to all other taxes, upon all the taxable property in such District sufficient to pay the interest on such bonds as it falls due and also to constitute a sinking fund for the payment of the principal thereof when due, said bonds to bear interest not to exceed the rate of ten (10%) percentum per annum, payable semi-annually and to become due serially within ten (10) years from their date?”

The regulation also improves alignment with current business practices by requiring the reporting of labor hours rather than new hires.  The Benchmark Notice establishes the current numeric goals for compliance with Section 3 requirements.

3. Section 109 of the Housing and Community Development Act of 1974, which assures that no person shall, on the grounds of race, color, natural origin or sex, be excluded from participation in, be denied the benefits of or be subjected to discrimination;

4. Certification of Non-Segregated Facilities, which assures the bidder does not maintain or provide any segregated facilities; comply with the terms of Section 504 and the American with Disabilities Act

5.  Equal Opportunity Provisions – Executive Order 11246, as amended, which assures non-discrimination;

6. Minority Business Enterprise and Women Business Enterprise provisions which encourage minority-owned business and women-owned businesses to bid on the project;

7. Assurances that surety companies executing bonds appear on the Treasury Department’s list and are authorized to transact business in the State where the project is located.

8. System for Award Management (SAM) registration and a Unique Entity ID number is required for CDBG Bidders (Prime contractors) in order to be awarded projects by the CDBG program. Bidders must go to Sam.gov to complete the registration process.

Chairman Mike Niblett called regular meeting of 10-27-25 to order at 9:15 a.m.  Others present Cacy Cribbs, Roy Wayne Blevins and Niblett, Floyd Ross, Nellie Garone, Jamie Utley, Mike Thompson, Terry Dupree, John Small, Guyla Hart, Sarah Carter, Stacey Pulley, Mark Canaday, Brooke Burch, Gary Dodd, Amanda Smith, Scott Kirby, Jason Bryant, Crystal Alvarez and Kathy Ross.  

Blevins proceeded with the prayer and Cacy Cribbs lead the flag salute. 

Cribbs moved to approve the minutes for regular meeting of 10-20-25, second Niblett, vote aye Cribbs and Niblett.  Blevins abstained due to being absent. 

Cribbs moved to Opening Public Hearing at 9:48 am for 19160 CDBG 23, Water Systems Improvements Project, Final Performance Report, Mintes and Notes, second Blevins, vote aye Blevins, Cribbs and Niblett.  Mareta Woodward with Parkhill could not be here, but asked us to proceed with closing and signing the grant paperwork.

Cribbs moved to approve to Closeout with Resolution #25-69, a Resolution Approving and Accepting the 19160 CDBG 23 Water Systems Improvements Project for the Johnston County RWD#3 of Johnston County as Complete and Authorizing the Chairman to Sign Closeout Documents, second Blevins, vote aye Blevins, Cribbs and Niblett.

Blevins moved to Resolution #25-70 to Purchase a 2018 John Deere Grader 672G, SN 1DW672GXPJF687912 from Pottawatomie County for $96,000.00 for Dist #1, second Cribbs, vote aye Blevins, Cribbs and Niblett.  

Blevins moved to approve Lease Purchase Agreement with Welch State Bank for 2018 John Deere Grader 672G, SN 1DW672GXPJF687912, $96,000.00 that is Being Purchased from Pottawatomie County, Terms 60 Months, second Cribbs, vote aye Blevins, Cribbs and Niblett.  

Cribbs moved to approve to Assist with Funding from the Opioid Abatement funds for the purchase of a women’s facility for the House of Hope – Silver Living House for Women, second Blevins, vote aye Blevins, Cribbs and Niblett.  Nellie Garone, Jamie Utley and Terry Dupree all spoke in regards to the request and the need of this purchase of a facility.  Garone states that this program started in 2023 and has grown very rapidly, they need a larger facility for future growth of the women.  Dupree states that he has spoken to the owners of the Milburn Family Clinic and are waiting for a response back on the decision of weather they will sell the property for a lessor amount to assist with getting this program off the ground.  If this is not workable, they will have to look for another facility.  Utley states that this is really a good, faith-based program and this helps the ladies acclimate back to the working and living in society.  Niblett states that this seems to be a good cause and that there should be more funding coming.  The facility that the ladies move from would be re-vamped for the men to be housed.  Cribbs states that Garone, Ross and himself had been up to speak to the ADA and that she had advised that this was an allowable use of these funds.  There is a balance of $167,430.31 in this account and would be available for the purchase of this proposed facility or we would need to discuss this further with possibilities of a different facility.    

Blevins moved to approve on Transfer from Senior Citizens General to Milburn Senior Citizens – $8,397.10, second Cribbs, vote aye Blevins, Cribbs and Niblett.  Milburn Senior Citizens has not been active since mid-1990’s and has come to the Commissioners requesting to open a facility and obtain operational funding.  They have an active board and have turned in the requisitioning & receiving officers to the Commissioners. 

Cribbs moved to approve to Approve Contribution-In-Aid-of-Construction Agreement for Electric Service at the Communications Tower Site in Wapanucka – Public Service Co of Oklahoma – $14,395.94, second Blevins, vote aye Blevins, Cribbs and Niblett.  This will be paid from the Communications funds.

Cribbs moved to approve to Lease Mower for Skid Steer to Mow Bridges, Dist #1, second Blevins, vote aye Blevins, Cribbs and Niblett.  This will be a continued lease with Warren Cat for 1 month.  

Reports gave by:  Guyla Hart – Assessor states that they were at the Assessor’s Conference last week.  There was a lot of talk on the ad valorem tax.  There were different speakers and sounds like they are considering to replace ad valorem with consumable tax.  This would be more on the lines of services.  The change of valuation figures will be a State Aid adjustment and they directed them to only change the schools that was a significant change in value amounts.  She spoke with Lorinda at the Mill Creek Schools on the change.  All others was a small amount of change.  Mill Creek Superintendent will be speaking with Ravia Schools.  They are requesting to be included in Mill Creek Schools.  Ravia has been requesting a legal description for the complete school district; the State will have that information and will need to provide.  Trunk or Treat is Thursday night and would like to have the Elected Officials banner to put up beside the vehicle.   Stacey Pulley – E911 states that she will be attending the ACCO Conference and she is in the middle of an audit.  Scott Kirby – EMS states that he attended the Assessors Conference last week and that things has really been busy at EMS.  Gary Dodd – Sheriff states that he will be in & out this week, that they will be attending the Major Crimes Conference this week at Durant.  Jason Bryant – EOC states that he has a meeting with Darrin about the Wapanucka tower project and PSO.  The Tish tower will be finish up getting the electrical power set and temporary power for the training center project.   

Public Hearing: Floyd Ross states that the Commissioners have done a great job for our County, wished that other folks would do the same.  Hope that we could get some other industry coming into Johnston County.  Sarah Carter – JCIA states that the industry is lacking the proper housing in our County.  Infrastructure is also another big problem.  There are people that is working on these issues and hope that this would be beginning to change soon.  There is a meet & greet with the Solar Farm and hope that all interested folks would attend.  New Business: None
